Courts and Tribunals (as of May 12, 2021)

  • Ontario Court of Appeal: The Court of Appeal has issued Amended Practice Directions regarding the conduct of matters. The amended directions also outline the requirements for electronic filing and transmission of documents, electronic service, and remote hearings.

  • Superior Court of Justice: Effective April 22, 2021, all in-person and virtual scheduled civil and family hearings/matters, which have not yet commenced, will be adjourned unless a judge determines that they are urgent, in which case they will proceed by way of a virtual hearing. Regional notices to the profession can be found here.

  • Divisional Court – The SCJ released a Notice to the Profession outlining that the Divisional Court will continue to hear matters remotely until further notice.

  • Ontario Labour Relations Board: The Board’s reception area and mailroom is closed to the public. Unless an in-person, written or telephone hearing is directed by the Board, all Board hearings (including previously scheduled hearings) will be conducted by video conference. The Board will continue to receive applications, responses, and other materials in accordance with its Rules of Procedure; however, all filings must be made electronically, using the Board’s e-filing process.

  • Federal Court: All hearings previously scheduled to be heard from March 16, 2020, through June 15, 2020, have been adjourned sine die and all General Sittings in that period have been cancelled. The Federal Court has issued an updated Practice Direction confirming that the Court’s facilities in Ontario and Quebec are being closed until further notice. The Court will continue to conduct its regular operations in those provinces by video conference, teleconference and in writing. Notwithstanding the expiration of the Suspension Period, the following paragraphs of the Federal Court’s Consolidated Covid-19 Practice Direction (June 25, 2020) are being continued until further notice.

  • HRTO: Hearings and mediations are being held by teleconference or in writing. New applications and documents are to be submitted by email. All in-person service counters are closed until further notice.

  • Workplace Safety and Insurance Board: Offices are closed to the public and it is taking longer than usual to process mail. Documents can be submitted online.

  • Workplace Safety and Insurance Appeals Tribunal: Since March 2020, alternative hearing methods, including teleconference, videoconference, or written hearings have been offered as an alternative to in-person hearings. The WSIAT has begun a limited and gradual resumption of in-person hearings, effective August 13, 2020. Effective September 8, 2020, there is a new e-filing service available on the WSIAT’s website.
